1. The Contract:

Full payment is required before your order can be accepted.
Once payment is received, we will confirm your order through email, creating a legally binding contract between you and us.
2. Price and Ownership:

The prices for goods you order are as listed on our website when you place the order.
These prices do not include value-added tax (VAT) or additional costs such as packaging, delivery, and insurance.
Delivery charges can be found on our website.
Until you have paid in full, the goods remain the property of Midlands Barber & Beauty Supplies

3. Payment:

We accept online Credit/Debit card payments, Bank Transfers, or Cheques.
Payment is expected before goods are dispatched.
Payment must be made in the currency we specify.
Timely payment is crucial.
Payment is considered received only when we have cleared funds.
All payments should be made in full, without any deductions, unless a valid court order requires otherwise.
4. Right to Cancel:

You have the option to cancel your contract at any time before we dispatch the goods.
To cancel, you must notify us in writing.
If the goods have already been prepared for delivery, you must return them at your expense and risk.
Upon cancelation, any amount charged to your credit card will be promptly refunded, usually within 30 days.
5. Cancellation by Us:

We retain the right to cancel the contract under certain circumstances:
Insufficient stock to fulfill your order.
Inability to deliver to your location.
Pricing errors due to typographical or supplier mistakes.
In such cases, we will inform you via email and refund any charges to your credit card, typically within 30 days. We are not obligated to provide additional compensation for any disappointment caused.
6. Delivery of Goods:

We will deliver the ordered goods to the address you specified at the time of order placement.
Delivery will occur as soon as possible following order acceptance and no later than 30 days from the order date.
Ownership of the goods transfers to you upon delivery. Subsequently, you assume responsibility for their safety, and we are not liable for any loss or damage.

7. Warranty:

If we are not the manufacturer, we will attempt to pass on any applicable manufacturer warranties or guarantees to you.
We guarantee that, upon delivery and for 12 months thereafter, the goods will:
Be of satisfactory quality according to the Sale of Goods Act 1979.
Be reasonably suitable for their intended purpose.
Be reasonably suitable for any specific purpose you communicated in writing, and we confirmed in writing that it is reasonable for you to rely on our expertise.
We are not responsible for warranty breaches unless:
You notify us in writing of the defect within three days of discovering it.
You provide us with a reasonable opportunity to inspect the goods if requested.
You return the goods to our place of business at your expense for examination, if required.
We are not liable for warranty breaches if:
You continue using the goods after notifying us of the defect.
The defect results from not following our provided instructions for storage, installation, use, or maintenance.
You alter or repair the goods without our written consent.
Under these conditions, we may, at our discretion, repair or replace the goods or refund the pro-rated contract rate. If we request, you must return the defective goods at your expense.
8. Limitation of Liability:

Unless specified otherwise in the warranty, our liability is limited.
Notification of issues must occur within specific timeframes.
We are not liable for indirect or consequential losses.
We are not responsible for customs or import permits.
These terms do not diminish your rights as a consumer under local laws or exclude liability for death or personal injury due to negligence.
9. Refunds:

Refunds are possible within 14 days of purchase, provided items are returned in their original packaging at your expense.
Contact us via email within 14 days to initiate a refund.
After 14 days, credit notes may be issued for items in their original packaging, valid for 12 months.
10. Notices:

All communications must be in writing.
Notices to us should be sent to our contact address, and notices from us may be displayed on our website or sent to the address you provided with your order. Any changes must be communicated in writing.
11. Events beyond Our Control:

We are not liable for delivery failures or delays due to circumstances beyond our control, such as strikes, system breakdowns, natural disasters, and accidents.
12. Privacy:

You agree to adhere to our privacy policy (applicable for online orders).
13. Third-Party Rights:

Except for our affiliates, directors, employees, or representatives, third parties have no rights under this agreement.
14. Governing Law:

English law governs the contract between us, and English courts have jurisdiction to resolve disputes.
15. General and Entire Agreement:

These terms, along with our current website prices, delivery details, contact details, and privacy policy, constitute the complete agreement.
Any representations made by our sales personnel are not binding unless explicitly included in this agreement.
If any provision of the contract is found to be illegal or unenforceable, the remaining provisions remain in effect.
Failure to enforce any provision does not waive our rights.
Except for cases of fraud or fraudulent misrepresentation, we are not liable for untrue or misleading representations.
